Bloomington man handed 3 years in 2022 sexual assault case

BLOOMINGTON, Ind. (IUSTV News) - A Bloomington man was sentenced to three years in prison Monday as part of a plea agreement with prosecutors in a sexual assault case from July 2022.

As part of the agreement, Darius McCormick, 33, pleaded guilty to sexual battery, a Level 4 felony, in exchange for the rape charge, a Level 3 felony, being dropped, and a three-year sentence.

Court documents say that on July 29 of that year, officers with the Bloomington Police Department met with a person reporting their daughter had been sexually assaulted the day before. When police attempted to interview the victim, she was reportedly breaking down and unable to communicate to investigators.

She later told police that she met a man, who she identified as McCormick, after he messaged her through Facebook. Court documents say that the victim reported McCormick was friends with her child's father.

Investigators learned that later that night, the two moved to the victim's bedroom after her children went to bed. Court documents say she told McCormick she did not want to have sex.

However, McCormick continued, and the victim reported that she said to stop multiple times, and that he was hurting her. The assault continued until McCormick finished.

Court documents show police found clothing, a pillowcase, and a towel that McCormick had touched.

A warrant was issued for him on Aug. 5, and he was arrested into the jail on Aug. 11.

According to online court records, McCormick was already serving a six-year probation sentence for a separate 2017 burglary case. He was arrested in 2021 for a separate rape case and took another plea agreement with prosecutors. He was given a one-year sentence.

Following his arrest in the August 2022 sexual assault case, a judge revoked his probation in the burglary case and he was resentenced to nearly 4 years in prison.

The three-year sentence in the newest sexual assault case will be served consecutively to the burglary case.
