The federal criminal case against a former IU student convicted for storming the U.S. Capitol on Jan. 6, 2021 has been tossed out after a pardon from President Donald Trump.

A judge dismissed the conviction against 31-year-old Antony Vo, who was convicted in Sept. 2023 for:

  • Entering and remaining in a restricted building
  • Disorderly and disruptive conduct in a restricted building
  • Violent entry and disorderly conduct in a capitol building
  • Parading, demonstrating or picketing in a capitol building.

He was sentenced to serve nine months in federal prison in April. He appealed his conviction and sentence last May, but never appeared for prison.

In her dismissal order, Judge Tanya Chutkan wrote "the dismissal of this case cannot undo the “rampage [that] left multiple people dead, injured more than 140 people, and inflicted millions of dollars in damage.”

Vo had fled to Canada after his conviction and was detained by Canadian police earlier this month.
