Mother-son duo arrested for breaking into apartment, beating man with tire iron

BLOOMINGTON, Ind. — A Bedford man and his mother are in jail for allegedly kicking down a door to a man’s Bloomington apartment and beating him with a tire iron.

Phillip Magness Jr., 38, of Bedford and Jamie Staten, 56, of Farmersburg, both face charges of burglary with a deadly weapon (a Level 2 felony), battery with a deadly weapon (a level 5 felony), possession of meth (a level 6 felony), and criminal mischief (a class B misdemeanor).

Staten is also charged with public intoxication (a class B misdemeanor), and possession of drug paraphernalia (a class C misdemeanor).

According to court documents, Bloomington Police took an assault report at an apartment complex just before 9:30 a.m. on July 12.

Police documented the man had severe bruising and swelling to his left eye. The apartment and the man’s face, clothes, and hands had dried blood.

At the hospital, the man told police that Staten had been staying at the apartment and around midnight that morning, she returned with Magness.

Court documents state that the man reported Magness kicked in the door and picked up a tire iron, beating his left eye with it once and before punching him in the eye five times.

Officers documented what was seen on security footage, which allegedly showed Magness and Staten standing outside the apartment at 11:58 p.m.

Magness then kicked the door four times to break open the door, court documents state, and while this was happening, Staten was holding a tire iron.

After the two were able to get inside, police documented that security footage showed Magness leaving the apartment soon after and Staten leaving once police arrived.

Magness and Staten had an initial hearing scheduled for Tuesday.

If convicted, the two could face up to 30 years in prison just for the level 2 felony charge, according to Indiana Sentencing Guidelines.
